Terms of Service

These Terms of Service ("Terms") govern your use of the POZR AI Shopify app (the "Service"). By installing or using the Service, you agree to these Terms.

Service Description

POZR AI provides AI-generated fashion imagery and video tooling for Shopify merchants. The Service reads the merchant's own products, generates new imagery or video at the merchant's request, and optionally applies generated assets back to Shopify product listings.

Acceptable Use

You must own (or be licensed to use) all product imagery you upload or reference through the Service.
You must not use the Service to generate illegal content, content that infringes third-party rights, sexually explicit content involving minors, or content that violates Shopify's Acceptable Use Policy.
You must not attempt to reverse engineer, resell, or abuse the Service's AI generation endpoints, rate limits, or billing system.
You are responsible for all activity that occurs under your Shopify store's installation of the Service.

Billing & Refunds

Paid plans are billed through Shopify's App Subscription billing system and are subject to Shopify's billing terms. Charges appear on your Shopify invoice. Cancellations take effect at the end of the current billing period. Refunds, if any, are handled per Shopify's refund policies. POZR reserves the right to change plan pricing with reasonable notice.

Ownership of Generated Assets

Subject to your compliance with these Terms and with the underlying AI model providers' terms, you own the generated assets produced from your own source imagery. POZR makes no warranty that generated outputs are unique or non-infringing.

Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, specific generation latency, or specific output quality.

Limitation of Liability

To the maximum extent permitted by law, POZR AI and its affiliates, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. Our aggregate liability for any claim shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold POZR harmless from any claims arising from your use of the Service, your source material, your generated outputs, or your violation of these Terms.

Termination

Uninstalling the app from your Shopify store terminates these Terms with respect to that store. We may suspend or terminate the Service for Terms violations, security reasons, or non-payment.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in California.

Changes

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
